# Introduction

Thanks for choosing Menekke as your trusted choice in development and hosting. All services are governed under the law of the Netherlands. When you order or have a active client panel at menekke.me you automatically agree with these terms and conditions. Refusal to comply with these terms will result in immediate termination of your order.

# Service

menekke.me provides a wide range of software/development services. These services may change at any time. You will be given a newsletter regarding the change of services if this may occure. These newsletters can be found on the client panel and at our discord server.

# Accounts

menekke.me has a different kind of account-management then ordinary services. This makes menekke.me directly accountable for the security of your account. With this function, menekke.me has to keep improving it's security which includes changes of our privacy policy. At menekke.me you log into your client panel with a access code, this access code grants anyone access to your panel which includes your full legal name, invoices and all other information, DO NOT SHARE YOUR ACCESS CODE!

# Acceptable Use

When ordering or collaberating with Menekke you must agree to the following conditions, breaking these conditions results in end of contract:

# User Content

After our process you will be transferred ownership of your product. Althought you have full ownership, you automatically acknowledge menekke.me as license holder, this is for usage in our portfolio and for general showcasing. You may NOT resell, share or distribute items or your product itself, this is strictly against our ToS and will be resolved with a DMCA strike (c-d letter on forehand).

# Privacy

Your data is handled under our Privacy Policy. All necessary information regarding our data collecting and your data can be found there.

# Termination

menekke.me may terminate/suspend access if these terms are violated. If you distribute or resell your product that was made by Menekke you will be faced with a Cease and Desist Letter (C-D Letter) and if that is to be ignored a DMCA Strike. Extreme copyright violations may be facing prosecution under the law of the Netherlands as described in our article about Law.

# Liability

The service is provided on an “as is” and “as available” basis, without any warranties of any kind, whether express, implied, or statutory. This includes, without limitation, implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

We do not guarantee that the service will always be secure, error-free, or available at any given time. Temporary interruptions, technical issues, or maintenance may occur without notice.

To the maximum extent permitted by law, Menekke shall not be liable for any damages or losses arising from the use of, or inability to use, the service. This includes indirect, incidental, consequential, or punitive damages such as loss of data, revenue, business opportunities, or goodwill.

We are not responsible for any content, actions, or services provided by third parties, including but not limited to hosting providers, external APIs, payment processors, or linked websites.

Nothing in this section excludes or limits liability where such exclusion is not permitted under Dutch or European Union law, including liability for intent (opzet), gross negligence (grove nalatigheid), or mandatory consumer protection rights.

If liability is legally established, our total aggregate liability shall be limited to the amount paid by you for the service in the twelve (12) months preceding the claim.

# Governing Law

These Terms of Service, and any dispute or claim arising out of or in connection with them or the use of Menekke services, are governed by and interpreted in accordance with the laws of the Netherlands.

This applies regardless of your country of residence or where you access the services from.

If any dispute arises, parties agree to first attempt to resolve it informally. If that is not possible, disputes shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands.
